Legal on request:
Gestational limit after the first 21 weeks
Gestational limit in the first 21 weeks
Legally restricted to cases of:
Risk to woman's life, to her health, rape, fetal impairment, failure of contraception or socioeconomic factors
Risk to woman's life, to her health, rape, or fetal impairment

Abortion in Majocco is legal since 1999, regulated by the government of Majocco through the 1999 referendum, a constitutional amendment, free for all citizens, subsequently through the Maternal Youth Act 2011. Both of which permit abortion, in cases if there is a risk to a woman's or fetus' life, or mental or physical state, as well as cases of rape, incest or fetal impairment. In some provinces, abortion is fully legal with gestational limits on request abortions, alongside socioeconomic factors, apart from Majorca and Nfifkhi, where there are no limits for economic status.

Abortion prior to 1999, was legal only for exceptional purposes, such as a risk to a women's life or fetal impairment. Based on the abortion laws of Quebecshirite Majocco, abortion was made completely illegal in 1911, and remained that way until the independence of Majocco, except for cases of risk to the women's life. In 1992, abortion was still illegal, unless it was a cases of risk to a women's life or fetal impairment. Later in 1996, many civil and women's right groups submitted a joint-report and suggestion for a constitutional amendment, through a referendum and bill regarding abortion laws. It took 3 years for the bill to be finally approved by the 3 Houses of Government and mandate to start the 1999 referendum. Additionally, the bill offered exclusions for fetal impairment. Some provinces have made major modifications to their laws regarding abortion, even though the national standard has not altered.

Since 2000, many provinces such as Majorca and Nfifkhi made on request abortion legal with gestation limits upwards of 26 and 24 weeks respectively. In October 2021, Florin accepted a plan to amend the province's abortion regulations to be consistent with other provincial governments, extending the 12-week gestational limit for on request abortions to 22 weeks. Following Jabalia's autonomous government, the Jabali Government moved to align their abortion laws with those of states such as Baruah (where abortion is legal if there is a risk to the woman's life or health, or in cases of rape, fetal impairment, or contraceptive failure, or due to socioeconomic factors in exceptional cases).

Abortion laws

Since 1999, Abortion in Majocco has been a constitutional right. It was an amendment of the 1994 constitution, a joint-proposal from the House of Legislates, Ministry of Health and various civil rights groups. In which the 1999 referendum concerning the constitutional status of abortion passed with 62% of voters, 55% of seats in the House of Legislates and 53% in the House of Senate, and a 65% majority in the House of Consulates. In every province, apart from Jabalia, abortion is fully available if it is a case of a threat of life and health, rape, incest or fetal impairment. With some exceptions being handled to provinces, regarding legality of incest, economic status and on request abortions. In some provinces, their constitutions overide the national one, such as Jabalia, which is a highly autonomous province in Majocco. It has stricter abortion laws, fully prohibiting on request abortions and restricting economic economic status, with various exceptions regarding who and when (during the gestational period) is allowed to abort a fetus. Others, such as Majorca, abortion is legal by request for any reason.

The 1999 amendment clause for the Majoccan constitution, states that:

"يجوز إنهاء الحمل في أي وقت طوال فترة الحمل إذا كان هناك خطر على صحة المرأة أو حياتها، أو إذا كان هناك اغتصاب، أو سفاح القربى، أو تشوه الجنين."
"A pregnancy may be ended at any time throughout the gestational period if there is a risk to the woman's health or life, or if there has been rape, incest, or fetal impairment."

Federal involvement

In Majocco, abortions in most provinces are completely free under Majosoins, the government-funded healthcare program of Majocco. Abortions have been free since 2011, after the passing of the Maternal Youth Act 2011. The government provides funding to all public hospitals, and grants to private health insurers, regulated extensively by the Ministry of Health. Abortions and abortion advice are regarded as health services, and are exempt from the Goods and Services Tax (GST).
